Another SBR question

Howdy,

I've been looking at the POF-USA website. I'm really contemplating getting one of their lowers and having it registered as an SBR so I can put the 9 1/2" upper on it.

Someone tell me how to start this process so I can hit the ground running when I get back to the states

To "make" an SBR, requires you to fill out 2 copies of ATF 5320.1 (Form 1), get CLEO signature, attach two passport photos and a pair of the correct fingerprint cards. Send the whole mess with check for $200. to the ATF.

(Must have serial number of the receiver on the Form 1.)

Would it be OK to register a lower as a pistol so I could go ahead and get my SBR upper while I wait for the paperwork to clear? I think this would keep me safe from the "intent to build" SBR law. Is this correct?

Yes, as long as the upper is less than 16 inches and does not have a vertical foregrip, you don't put a shoulder stock on it, and the receiver has never been registered as a rifle.

Once the SBR paperwork comes back, then you're good to go on the foregrip and shoulder stock.

Don't forget the Citizenship Form that is also required now, or your application will be suspended until one is submitted.
