Woman sentenced in police officer's death

Mary Jane Rivas, 32, was just barely out of prison after serving time for possession of cocaine when she got high again on Aug. 13, 2006. This time she was behind the wheel of a speeding SUV that blew through a Central Area red light at more than 80 m.p.h. and broadsided a patrol car driven by Seattle police officer Joselito "Lito" Barber, 26.

Rivas, who suffered a broken leg in the crash, was in the passenger seat of the GMC Yukon when the first officers arrived, saying the driver just fled. Investigators were quickly able to prove she was driving the vehicle and a search turned up cocaine hidden in a body cavity.

Witnesses, including other police officers, say the SUV was traveling so fast that it became airborne just before striking Barber's patrol car. Barber had been on the force for just five months.

Rivas had been out of prison for just 10 days and already was wanted by police for theft, driving while intoxicated and malicious mischief. She had failed to report to her parole officer and was also wanted by the Department of Corrections, records show.

Rivas had been in and out of prison since 1995, mostly for drug and property crimes.

In summer 2006 she served two and a half months for possession of cocaine, but was released early after agreeing to enter drug treatment. She was charged with that crime after an Everett police officer pulled her over and found cocaine in the vehicle. She was driving on a suspended license at the time.

Rivas pleaded guilty in September to aggravated vehicular homicide for Barber's death. King County prosecutors promised to seek an exceptionally long prison sentence, based on a statute that allows a judge to impose a longer sentence if a defendant commits a crime "shortly after being released from incarceration." At a minimum, she faced between 10 to 14 years in prison.

Unfortunately, Washington (especially near Seattle) is the granola munching capitol of the NW. She'll get 14 years, and will serve 6-8, in all probability.

Unbelievable! They didn't exactly say what the sentence is. She oughta' get a thirty-year sentence. How many felonies has she committed? Seems like there oughta' be a "habitual offender" thing in there somewhere. Scum is right.

She got 20-21 years, aggravating circumstance was that she was a recent release and on "supervision". I met his family a little while ago - wonderful people.
