Pistol lower, $10 more

Looking at a build and found a Mega pistol lower for $10 more than there standard multi lower! Ok when I have more than 1 ar this alows me to switch this one back to a pistol?? unsure.gif

Is It worth the $10?

If the 4473 is marked other or receiver, which it should be according to new ATF guidelines. You also need to build it as a pistol first. You don't need a pistol length upper, you just need to build the lower with a pistol buffer tube. If you do that, you can switch back and forth.

You can build a Gator into a pistol as long as you follow the instructions above. Some people prefer the insurance of having "pistol" marked on the lower.

I built a pistol on a non-pistol marked lower. You can change it to a rifle at any time you want, but you CANNOT go back from a rifle to a pistol.

As long as it was originally registered as a pistol and you remove the stock BEFORE you put the pistol upper back on, you can go back to pistol. Also if it was originally registered as a pistol and you do convert it to rifle and decide to sell, it has to be sold as a pistol regardless of what configuration it is in.

You can have any length barrel you want on a pistol lower, including rifle length. You just can't have a barrel shorter than 16 inches on it with a stock attached or it is a SBR. Remove the stock and then put the pistol lower back on and you are GTG.

Got to love the convoluted BATFE laws.

This is the only part I am not sure about. Once you put the stock on it, and put a 16 in or longer upper on it, it is a rifle. And you cannot go from rifle to pistol. The lower it the part that would be defined as the rifle or pistol. Legally if you have a rifle and put a pistol upper on it and a pistol buffer tube, you do not have a pistol, but an illegal SBR.

Id like to see that low if you know where it van be found though, but all the guys in the Full Auto Armory have told me that you cant go back to a pistol.

I got the same info when I was looking into building a pistol lower. As long as it isn't logged as rifle, you can build it as a pistol first, then switch back and forth. I went back and had the manufacturer make sure that mine was counted as a receiver and not a rifle. The trouble comes in if you have to prove it. That makes it doubly important that you build it as a pistol first.

Of course if you build it as a rifle first or put a less than 16 inch permanent length upper when it has a stock, it's an (illegal) SBR.

I was just checking out my thread about this in the Full Auto Armory and I remembered it wrong. One person says that its debatable, but zack, who I would trust when it comes to this kind of stuff, says its legal as long as the stock isnt on the same time as the short upper.

Correct. BATFE has already issued an opinion stating this. Just remember if it was originally built as a pistol and you sell it, regardless of it's configuration, it must be transferred to the new owner the same as a pistol is. If you leave the short barrel on with a stock it is a SBR and you must have the appropriate tax stamp for it.

Dude on the other forum just got this letter from the BATFE:




Definitely seems to indicate it would not be lawful to assemble a lower in a rifle configuration and subsequently change to a pistol configuration. Of course, very little that the ATF proclaims makes much sense. I don't doubt, though, that they would happily prosecute someone for making a pistol with lower that was configured as a rifle if they were so inclined.

Ultimately, no one would likely know and it wouldn't make any difference if you were to swap back and forth. You'd probably have to do something colossally stupid and have the absolute worst luck for it to be any kind of issue.
