Legal question about Class III items.

Ok not trying to be a smart arse or anyting but lets say a person owns a couple of Title II items. I know several folks here do. And lets say that something like Katrina happens in your area and the powers that be decide to strip you of your Constitutional rights and come and get your guns. Lets even say that you decide to cooperate with them and give them up for what ever dumb arse reason. What about the SBRs, FA, SBSs or what ever class III gun you have. By giving it to them, are you not transfering a registered gun without ATF approval?

Just wondering. If it happens here when the police show up all my my guns will be in the safe and it will be bolted to the concrete floor and they can not make me give up the combo. Anything that bad and I doubt they will be able to get enough eletricity to drill it if they can find a locksmith.

Kinda my take on it

But to answer your question confiscation is confiscation they would not need or care about paperwork, it would be ruled just like a seizure when the Police seizes weapons or drugs.

ohh no way in hell I am willingly giving mine up I just wondered about willingly handing it over to a LEO without transfer paperwork. As they would be coming in without a warrent or just cause and taking property without due process.

Remember that there are exemptions in most states for LE and class III weapons. It's not legally a "transfer". I've even heard of people who were going on long trips out of the country storing their class III stuff with local LE while out of town. No transfer required, it just would sit in an evidence room until the owner requests it be returned.

Ok just wondered. I guess if you did not have a gun safe the local PD would be the place least likley to have it stolen from.
