Guys, what is the difference between class 3 and a "Destructive Device" Some weapons are not full auto, but they are still a DD and need the stamp? How is that determined?

NFA regulations cover several types of weapons.

Machine guns
Short barreled rifles
Short barreled shotguns
Destructive Devices
Any Other Weapon


A destructive device is an interesting category. Shotguns like the street sweeper are DD's because they have a bore size over .50 and supposedly have no sporting purpose and were declared a DD.

Destructive device also covers things like mortar tubes, grenade launchers, grenades, various explosives, artillery pieces and the like.

Seems like they could deem anything a DD, like maybe a AR. It is rather vauge.

The 1934 NFA is relatively clear. The GCA of 68 is extremely vague. The BATFE pretty much defines what it means. That's how we went from being able to get complete AK kits to build or repair to AK kits with no barrel for builds to complete kits for repair only to no more AK kits.

seems to be the whole purpose of having a bureau, agency or a commission. This way gubbmint can pass laws congress has no power to write.

A class 3 license allows you to deal in NFA items other than destructive devices. You need A DD license if you want to deal in explosives, including fireworks.

With a class 3 license, you are allowed to do a few DD transactions, but not anything that would be considered a business.

There are a few firearms that are classified as DDs... like a street sweeper for example.

I was just thinking that they could just declare anything a destructive device if they wanted to do an end around the Congress.

Dont know if it is true or not but I have heard the ATF coming down on folks for having "tater guns" under the DD definition.

yes and no.


if it is explicitly designed to fire potatoes or other 'non anti-personnel' ammunition they don't care.

flaming tennis balls, canister shot, etc = DD
